Business owners fined and made to take action about waste and grime

On 9th January 2023, 23rd February 2023 and 11th April 2023, Enforcement Officers conducted uniformed patrols in York Place, at the rear of business premises, Kitchenette Lounge Ltd, 5 7, York Road, Ilford IG1 3AD. On each occasion he saw that the large commercial waste bins, used by the restaurant were open and overfilled with bags of waste. There were cardboard boxes, black bags of food waste and cooking oil drums deposited alongside the bins. His enquiries revealed that a Sec 47 Environmental Protection Act 1990 Notice was in force for the business, such a notice makes specific requirements as to how the companies waste should be stored and presented. The officer sent fixed penalty notices to the company, no payments were received, despite reminder letters being sent. Matters were passed to Enforcement Case Officers to pursue a prosecution against Kitchenette Lounge Ltd, 5 7 , York Road, Ilford, for breaching Sec 224(3) Town & Country Planning Act 1990. The Magistrates heard the case in the company’s absence and found the charges proved. The company had a previous conviction for the same offence heard at Barkingside Mag Court on 6th December 2023, where they were fined £2135.00, this was taken into consideration by the Magistrates.

On two dates in March 2023, Enforcement Officers were on uniformed patrol in Thompson Close, Ilford. They saw that high scaffolding had been erected on the public footpath in Thompson Close, at the rear of 325 331, High Road, Ilford IG1 1NR. The scaffolding had a sign attached with the name UK High Level Scaffolding Ltd, the officer checked to ascertain if the company had applied for a permit/license to erect scaffolding at that location, no such permit had been issued. The officer sent fixed penalty notices to the company UK High Level Scaffolding Ltd, 37, High Street, Chatham, Kent M E4 4EN, no payments were received, despite reminder letters being sent. Matters were passed to Enforcement Case Officers to pursue a prosecution against UK High Level Scaffolding Ltd, for breaching Sec 169(5) Highways Act 1980. The Magistrates heard the case in the company’s absence and found the case proved.

Fined £500, costs 772, victim surcharge £100, total £1,372.00, 28 days to pay.
